TERMS AND CONDITIONS OF SERVICE

This agreement governs the provision of dental laboratory services by Ak Smile Lab Ltd (registered in England & Wales, Company No. 15780373) to dental professionals (“Clients”). By submitting cases, Clients agree to these terms.

  1. Definitions
  • “Case”: Dental restoration(s) requested by Client (e.g., crown, denture).
  • “Materials”: Substances used (e.g., zirconia, PMMA).
  • “Digital Files”: Scans, designs, or prescriptions submitted.
  1. Order Acceptance & Pricing
  • Quotes: Valid for 30 days; prices may vary if specifications change.
  • NHS Cases: Subject to fixed pricing under NHS contractual terms.
  • Private Cases: Charged per current fee schedule (provided on request).
  1. Client Responsibilities

         Clients must:

  • Provide accurate prescriptions (including shade, occlusion, medical alerts).
  • Submit usable impressions/scans (rejected if unusable; resubmission fees apply).
  • Obtain patient consent for data sharing per GDPR.
  1. Turnaround Times
  • Standard: 5–7 working days (from receipt of workable materials).
  • Urgent: 24–48 hours (+30% fee; excludes weekends).
  • Delays: Not liable for postal/courier delays or incomplete prescriptions.
  1. Warranties & Remakes
  • Defects: Free remake if fault is lab-side (reported within 14 days).
  • Exclusions: No warranty for:
    • Patient-induced damage (e.g., bruxism).
    • Cases with incorrect prescriptions.
  • Refunds: Discretionary; no cash refunds after work begins.
  1. Liability
  • Cap: Liability limited to case value (no consequential loss claims).
  • Clinical Decisions: We follow prescriptions; final responsibility lies with the dentist.
  1. Payment Terms
  • Invoices: Due within 30 days (2% monthly interest on late payments).
  • Private Clients: 50% deposit for orders over £500.
  • Disputes: Notified in writing within 7 days of invoice.
  1. Intellectual Property
  • Designs: Ak Smile Lab retains rights to CAD files; Clients license use for patient treatment only.
  • Scans: Patient data remains dentist’s responsibility; we delete files post-retention period.
  1. Termination
  • By Us: If Client breaches terms (e.g., non-payment).
  • By Client: Written notice; pays for work completed.
  1. Governing Law & Disputes
  • Jurisdiction: English courts under laws of England & Wales.
  • Mediation: Parties agree to negotiate disputes before litigation.
  1. Force Majeure

Not liable for delays/cancellations due to:

  • Pandemics, strikes, or material shortages.
  • IT failures beyond reasonable control.
